Motorcycle Related Accidents in Las Vegas and Nevada on the Rise

Each year many more people are discovering the pleasure and economic benefits of riding a motorcycle. Due to the relatively consistent weather in the Nevada desert, motorcycle riding is a yearlong activity. However, riding a motorcycle is not entirely fun and games. Motorcyclists are required to have the needed skills to operate such a vehicle safely on Nevada highways and roads. Regrettably, the safety of motorcyclists is not always within their control.

Motorcycles offer very little protection for their rider in the event of a crash. Even wearing the proper safety gear cannot always guard the rider from injuries, or even death, in a severe motorcycle accident. Consequently, Nevada motorcycle riders are often at the mercy of reckless and negligent drivers, dangerous roadways, faulty maintenance and/or careless motorcycle manufacturers.

In a report released by the Governors Highway Safety Association (GHSA), 42 people were killed in Nevada motorcycle accidents in 2009.  Although the numbers through the first nine months of 2010 indicate a slight decline in motorcycle-related accidents, the final numbers are expected to show an increase in Nevada motorcycle accident fatalities for the entire year of 2010. Many times an automobile driver’s failure to see bikers is, unfortunately, a principal reason motorcycle accidents occur. As indicated by the Department of Transportation’s motorcycle safety study, three-quarters of all motorcycle accidents involve a collision with another vehicle – most often a passenger car. The other vehicle’s driver frequently reported not seeing the motorcycle or not having enough time to avoid the accident. If someone is injured or killed in a Nevada motorcycle accident – and it is the result of a negligent driver – that person or their family can file a Nevada personal injury lawsuit in response to the incident.

Motorcyclists have the same rights and responsibilities that drivers of passenger vehicles have. Thus, if a rider becomes the victim of the negligent or reckless actions of another, he or she has the right to hold the at-fault party liable for the injuries they endure. Due to our extensive and comprehensive experiences with personal injuries we, at Benson and Bingham, understand the pain associated with such accidents. We pride ourselves on client service and will work with you to help you receive the reimbursement you deserve. If you or someone you know has been injured in a motorcycle accident, please speak with one of our experienced attorneys who can advise you in your rights under Nevada law. The personal injury attorneys at Benson and Bingham are committed to protecting the rights of motorcyclists.

Brain Injury Fears Spur Nevada Parents to Steer Their Sons Away From Football

The National Football League is the most popular league with the most popular sport in the United States. Nearly every year, the Super Bowl, the league’s championship game, scores all-time high television viewer ratings. Networks like ESPN, CBS, NBC and FOX spend millions just for the rights to broadcast games. The quality of the games usually do not matter, the ratings for nationally televised games featuring teams at the bottom of the standings are usually the highest for all shows broadcast that evening. During the offseason, skills competitions and the Pro Bowl (the NFL’s All Star Game), continually get great ratings. Even college football’s ratings are on the rise. It has been repeatedly discussed throughout the media that concussions and the long term effects of repeated concussions are the only threat to football’s hegemony over America’s media landscape. If you or someone you love has suffered long-term brain injury from a football related concussion at any level (high school, college or professional) and would like to recoup money for lost work, medical costs and pain and suffering, contact Benson and Bingham for a free legal consultation today.

While the NFL and football at all levels are altering procedures for concussion care, these precautions may not adequately address the problem. Harvard University is currently collecting the post-mortem brains of football players from all levels to study the effects repeated concussions. They have found brains of normally healthy 40 and 50 year old former players that resemble the brains of elderly sufferers of Alzheimer’s and other forms of dementia. The danger to the sport’s popularity will likely come from a continued reduction of players – if the dangers from post-concussion dementia continue to drive parents from allowing their children to continue to compete in the sport, the talent pool could dry up. Troy Aikman, the Super Bowl winning, Hall of Fame quarterback from the NFL’s most popular franchise recently stated as much during an appearance at a Zócalo Public Square event in Los Angeles. If you have suffered from depression and reduced mental capacity from repeated concussions playing football, contact Benson and Bingham to discuss your case today.

Benson and Bingham are Nevada personal injury attorneys who lead the state in personal injury cases. While the attorneys have successfully litigated many brain injury cases they have also won multiple car accident, workplace injury, wrongful death and other types of personal injury cases. In 2010 and 2011, the firm successfully accrued over $24,000,000 in awards for their clients.

The Evolution of the Manual on Uniform Traffic Control Devices (MUTCD)

The Manual on Uniform Traffic Control Devices (MUTCD) is a government publication issued under the guidance of the U.S. Department of Transportation, Federal Highway Administration.  The manual sets the minimum standards and ensures uniformity throughout Nevada, as well as the United States,  for all traffic control devices.  The document is constantly changing as new technologies, traffic innovations and rules and regulations evolve through the country, but is constantly being incorporated by local law standards, including the Highway Patrol, Sheriffs and other police officers in Nevada.

The first MUTCD was first  published in 1937 after the American Association of State Highway Officials (AASHO) and the National Conference on Street and Highway Safety (NCSHS) combined to form the Joint Committee on Uniform Traffic Control Devices (JC).  While the manual was first produced in 1935, it was only published two years later since demand for the information was so high.  Obviously as the rules of the road changed dramatically over time the document has evolved considerably since its inception.  New traffic devices and other rules for construction and maintenance operations were only addressed with the start of the Interstate Highway System.

Today, the document is still used throughout the country as a guide on both National and State levels.  Due to the constant changing of the documentation, the best place to find the most current version of the MUTCD is on their website, www.mutcd.fhwa.dot.gov.   The publication is constantly evolving and takes suggestions from local and state agencies as well as other quasi governmental traffic agencies; so, if you believe there is a currently problem with the way a device operates or the rules of the road, don’t get mad, get even and contact the MUTCD with your gripe.  Otherwise, if you have been cited for failure to use due care, or other tickets including reckless driving, speeding tickets or warrants, contact the experts at Ticket Power.

Why are Attorneys in Nevada Not Taking Medical Malpractice Cases?

It is a sad but true circumstance that more and more reputable attorneys in Nevada are no longer interested in representing victims of a Medical Malpractice in the state of Nevada.  The reason being that the law caps the amount of money that can be earned by the attorney, even though medical malpractice cases are sometimes the most costly and time consuming areas of Personal Injury law to litigate.

Nevada’s MedMal caps were set several years ago as follows: Forty percent of the first $50,000 awarded; 33 and one-third percent of the next $50,000; 25 percent of the next $500,000 awarded; and a cap of 15 percent for awards of $600,000 or more.  However, the reality is that many of these cases cost more then an attorney can recoup in legal fees once the trials is completed.

Recent studies showcased on Sixty Minutes and other media outlets note that the reason health care fees are going up is not a result of malpractice suits being filed against hospitals and doctors; in fact, less then 1% of all health care fees are chalked up to medical malpractice litigation, even though some of these people suffer the most debilitating of injuries due to surgical error, mix-up in records or other gross forms of negligence by the medical establishment.

The solution?  It sounds like the law needs to be rewritten if Federal and  State governments are truly interested in protecting Americans.  The reality is that medical malpractice is very difficult as well as costly to prove, with the hiring of experts, medical tests and other processes that accompany a suit of this nature, and without an attorney this process is nearly impossible.

For more information on why Nevada attorneys are no longer interested in pursuing such claims, read: Why Excellent Nevada Trial Attorneys WILL NOT accept good Medical Malpractice Cases
